FIRST - WHAT IS DAY OF COURT™ PRIVATE COUNSEL?

We believe a litigant should never “Go It Alone” in family court. Family law litigants should have an option to have a lawyer represent them at their day of court. Our only goal is to try to do just that.

Our ultimate aim is to provide all family law litigants with at least the opportunity at court to retain a high quality, professional lawyer to temporarily represent them for the day.

We are a privately held Canadian company focussed solely on the placement of pre-qualified, high quality, pay per use experienced family law lawyers on-site at courthouses.

The Day of Court™ Private Counsel lawyers on our panel provide their services on-site on demand at the courthouse to family law litigants. As individual lawyers, they are responsible for their legal advice and representation and their professional conduct directly to you, the public.

WHAT DO WE DO?

Day of Court™, through our parent company LitiLink Litigation Services Inc., recruits high quality and experienced Ontario family lawyers to be part of a panel of lawyers to provide on-site lawyer representation to the public to assist them with their day in court.

We also manage the scheduling of the Day of Court™ Private Counsel lawyers in coordination with the local family court calendar to ensure that they may be available at the court house when family court is in session.

Day of Court™ Private Counsel itself cannot and does not provide any legal advice to or legal representation of family law litigants. That is the job of our expert Day of Court™ Private Counsel panel lawyers.

HOW CAN DAY OF COURT™ PRIVATE COUNSEL LAWYERS HELP YOU?

Day of Court™ Private Counsel panel lawyers can help you with important things such as:

  • Speaking in court to present your case to a Judge
  • Identifying appropriate court materials required for your day in court
  • Helping you to understand the current and next steps in your case
  • Helping you to negotiate or speak with your opposing party’s lawyer or your opposing party so that agreements on issues in your case may be contemplated and achieved

Day of Court™ Private Counsel lawyers are there to help provide short-term temporary representation at the following types of court attendances only:

- Rule 39 Hearings
- Case Conferences
- Settlement Conferences
- Trial Management Conferences
- Motions for Temporary Relief Orders
- Paid assistance with representation during on-site family court mediation sessions may also be available if appropriate

**Please note that Day of Court™ Private Counsel lawyers do not and will not provide assistance with contested cases which involve Final Orders to be made on motions, at conferences or trials.**

HOW DOES THIS SERVICE WORK?

Limited Scope Retainer Agreement - The Day of Court™ Private Counsel lawyer is hired by you, the family court litigant, directly at the courthouse on your day of court on an hourly rate basis.

Prior to the provision of the lawyer services to you, you will review and enter into a document called a Limited Scope Retainer Agreement. The Limited Scope Retainer Agreement is a detailed setting out of the service to be provided to you and the hourly rate fee (plus hst) to be paid by you directly to the Day of Court™ Private Counsel lawyer. Both you and the Day of Court™ lawyer sign the form.

Payment - Upon the conclusion of your day of court, you, the family law litigant, pay for the lawyer’s time on-site. You are provided with a bill immediately and payment for the bill is due to the lawyer immediately.

Your bill can be paid through electronic means such as by credit card or email money transfer. The specific payment method will be discussed and agreed upon by you and the Day of Court™ lawyer during the review of the limited scope retainer agreement.

Payment for these at court services is not made to Day of Court™, nor can we accept payment. You pay the lawyer who provided you with the service directly.

WHEN ARE THE SERVICES AVAILABLE?

We will make every effort to have lawyers available on-site as much as possible, however, we are a brand new lawyer service just getting started, one Ontario region at a time. We will not necessarily have a lawyer on-site for each and every court date at each and every courthouse at this point.

However, if you are self-representing in your family court case and you see a lawyer at the courthouse with the feather logo name badge on their lapel, that means a Day of Court™ lawyer is on-site and may be hired for the day to help you.

The Day of Court™ Private Counsel lawyers will be located in the general area of the family law courtrooms at the courthouse.

WHERE ARE THE SERVICES AVAILABLE NOW?

Durham Region - Currently, we at Day of Court™ are preparing to launch our first of its kind on-site, on demand lawyer service program in the Durham Region courthouse in Oshawa, Ontario which will commence in April 2018.

**Important Information About the LIMITS and RESTRICTIONS of the Day of Court™ Private Counsel Services:

1. Please note that you cannot pre-retain a Day of Court™ Private Counsel lawyer in advance of your court date. The service is only provided on a first come, first-served basis in real time on-site at the court house.

2. As well, you cannot continue to retain the Day of Court™ Private Counsel lawyer beyond or after the court attendance concludes for your day.

3. You can, at your next court attendance, once again secure the services of a Day of Court™ Private Counsel lawyer, if available that day. However, you may in all likelihood have a different lawyer.

4. While every effort will be made to have Day of Court™ Private Counsel lawyer services available as often as lawyers are available in the area to provide the service and the public demands it, as this program is in its beginning stages, we cannot guarantee that Day of Court™ Private Counsel lawyers will be available at each and every court date.

5. To help the Day of Court™ Private Counsel lawyer best serve you, in advance of your court date please be sure to collect all documentation you have as it relates to your case and bring it to court with you.
